IMPORTANT UPDATE:
As anticipated in the notice below, the Board of Trustees considered the Batch 6 proposed rules at its meeting on May 15, 2010. The Board of Trustees conditionally adopted eleven proposed rules. This includes a Batch 5 proposed rule, Rule 1.10, which was submitted to the Board for reconsideration. The Board action directed that these rules be added to the comprehensive public comment distribution of the entire body of proposed rules in a manner that affords at least 30-days before the public comment deadline of June 15, 2010. In accordance with the Board's direction, the eleven proposed rules conditionally adopted by the Board have been added to the current public comment proposal and the relevant public comment materials have been updated. Each of these rules is identified by the designation: "Updated 5/17/10." This designation appears even if the text of a rule was not changed as a result of the Board's action.To determine the changes, if any to a specific rule, refer to the rule Discussion Draft materials. Finally, the document reporting on "Rules/Concepts Not Recommended for Adoption" has been updated based on the Board's action to address the new status of Rules 4.1 and 6.1, as rules that are not being recommended for adoption.

These documents are being made available at this proposed rules page on a temporary basis to facilitate member and public access to the materials under consideration by the Commission, following the June 15, 2010 public comment deadline. Further public comment on Commission proposals, if any, would be accompanied by a public comment notice at the Public Comment page of the State Bar’s website.
The Commission on the Revision of the Rules of Professional Conduct is seeking public comment on the proposed Rules of Professional Conduct listed below. Please read thepublic comment notice for more information.
The public comment deadline is: June 15, 2010.
With the exception of the rules designated as "Batch 6" rules, the rules listed below were distributed for an initial public comment period in separate batches and many were revised after consideration of the public comments received. They were then submitted to the Board of Trustees for preliminary consideration. The adoption by the Board was conditioned on this subsequent public comment distribution of all of the proposed rules. It is anticipated that the Board will consider adoption of the new rules at the conclusion of the public comment period, after the comments received are reviewed by the Commission and any subsequent revisions are made.
