Filing a Complaint
May I ask for fee arbitration if I want a refund of fees I have already paid to an attorney?
You may request mandatory fee arbitration at any time as long as your request is made within the period allowed to bring a civil action seeking judicial resolution of a fee dispute. The period for an oral contract is two years, and the period for a written contract is four years.
However, if an attorney has provided you with notice of your right to fee arbitration, you have only 30 days to file. To preserve your right to arbitrate, you should file a request for arbitration promptly.
