On June 29, 2009, the new amendments to the California Discovery
Act (C.C.P. Title 4) for Electronically Stored Information (ESI),
“AB5,” came into force. Until now, California law has
not specifically addressed ESI and its acquisition, production, and
use. Although treated similarly to “documents” under
the previous statutory regime, critical differences will have a
dramatic impact on California litigation
