The terms and conditions of employment for State Bar staff, including compensation and benefits of employment, are governed by union negotiated Memoranda of Understanding for employees in the General and Attorney Bargaining Units, the Rules and Regulations Pertaining to the Employment of Executive Staff for management employees and the Rules and Regulations Pertaining to the Employment of Confidential Employees for designated Confidential Employees. The State Bar is a public corporation governed by the Meyers-Milias-Brown Act, California Government Code Section 3500 et seq., for labor relations purposes. Salaries are set in accordance with a classification and grading system. Employment benefits are set by the governing rules referenced above.
State Bar Court judges are not State Bar employees. They are appointed to terms of service in accordance with the governing statutes. See Business and Professions Code Sections 6086.5 [State Bar Court, Establishment, Powers, Rules]; 6079.1 [State Bar Court Hearing Judges]; 6086.65 [State Bar Court Review Department]. The State Bar is, however, mandated by statute to pay the salaries and benefits of State Bar Court judges. These are set by statute and by the Rules and Regulations Pertaining to the Benefits, Terms and Conditions Governing State Bar Court Judge Service.
