The State Bar of California is seeking to inform former State Bar licensees that through December, they can settle their State Bar debt by paying half of the balance they owe through the Fresh Start Settlement Program. The one-year program is an offer and compromise opportunity for current and former State Bar attorneys. To participate, applicants must request a settlement through an online platform, and any approved settlement must be paid in full by December 31, 2025. 

Outstanding debt would include disciplinary costs, Client Security Fund reimbursements, and/or monetary sanctions owed to the State Bar. Those with validated financial hardships can seek larger debt reductions. 

Active attorneys who are currently allowed to practice law and attorneys on voluntary inactive status are offered a 20 percent discount through the program for unpaid disciplinary costs that are due in future years. 

The State Bar has had hundreds sign up to participate since the program launched in February. However, for former attorneys who have not had an active license for years, there is concern that email and physical addresses on file with the State Bar might not be current. 

“The Fresh Start Settlement Program allows attorneys and former attorneys to move past their debt and move on to new possibilities,” said Erika Doherty, State Bar Interim Executive Director. “It is a one-time opportunity, and we want to ensure that all those who are eligible are aware of the program and its benefits and relief.” 

The Fresh Start program aims to enhance repayment rates for participants while mitigating the severe consequences of debt, including wage garnishments and an impact on credit scores. This program was approved by the Board of Trustees to align with parallel efforts to make the discipline system fairer and improve revenue collection. 

There are no disadvantages to participating—no harsh negotiations for participants, no need to prove financial situations unless seeking an increased reduction through a hardship declaration, and no extra fees or interest through December 31, 2025. Former attorneys simply pay half their State Bar debt balance for full resolution.
