State Bar Seizes Gardena Practice for the Unauthorized Practice of Law

The State Bar of California seized the Gardena practice of George Y. Takahashi, doing business as American Legal Counseling, Advanced Legal Services, and American Horitsusodan, announced George Cardona, the State Bar Chief Trial Counsel today. The Office of Chief Trial Counsel (OCTC) received an interim ruling from a Los Angeles Superior Court after Takahashi engaged in the unauthorized practice of law (UPL) by providing legal services and holding himself out as an attorney. 

Can the State Bar recommend a Live Scan vendor?

The State Bar does not oversee Live Scan vendors and cannot endorse or recommend vendors to attorneys.The DOJ has a list of certified Live Scan vendors. Attorneys are encouraged to select a California DOJ certified Live Scan vendor.

I submitted my fingerprints through a Live Scan vendor and entered in the ATI number on the My State Bar Profile. Do I need to mail my Live Scan form to the State Bar?

No. Once you have submitted your fingerprints through a Live Scan vendor and received an ATI number, you should retain a copy of the Live Scan form for your records.

Upon submission of the ATI number on the Proof of Live Scan Submission page, the fingerprinting requirements status will be updated.

What do I need to do to be compliant with California Rule of Court 9.9.5?

Your My State Bar Profile will indicate the steps you must take to satisfy the fingerprinting rule requirement. Compliance with the Rule will be effective on the date you submit proof that you were fingerprinted pursuant to the State Bar’s instructions. For more information go to your My State Bar Profile.

I am an active attorney and currently serving in the military outside of the country. Do I need to satisfy the fingerprinting rule requirements?

Yes. A United States embassy or consulate, as well as local law enforcement agencies, may provide the necessary fingerprinting services. 

What happens if I choose not to get fingerprinted?

Failure to comply with State Bar fingerprinting rule requirements will result in the suspension of your license.

I want to complain about content in a State Bar–approved MCLE course. How do I do that?

Pursuant to rule 3.605 of the Rules of the State Bar, the State Bar does not intervene in disputes between a provider and an attendee or potential attendee. However, complaints that the State Bar receives regarding a provider are considered in assessing the provider’s compliance with State Bar certification rules. Please email your concerns to providers@calbar.ca.gov.

Must I report compliance if I am exempt?

Attorneys who meet the exempt criteria must report compliance by claiming their exemption every compliance period. They should do so online by logging on to "My State Bar Profile." Without a statement of compliance, the State Bar has no way of determining whether or not an attorney was exempt for any particular compliance period.

State Bar of California Releases Results of Independent Investigation of Former Board Chair Sean SeLegue’s Involvement in a Disciplinary Matter Regarding Thomas Girardi

The State Bar of California today released reports from an independent investigation into whether former Chair of the Board of Trustees Sean SeLegue had a disqualifying conflict of interest arising out of his involvement with a 2010 discipline case against since disbarred attorney Thomas V. Girardi. The investigation found that Mr. SeLegue did not have a disqualifying conflict of interest and that neither he nor other State Bar leaders engaged in misconduct. The reports, which have been redacted on a limited basis as required by law, are being shared in keeping with the State Bar’s commitment to transparency.
